1.Eligibility: The St. Patrick’s Day Giveaway is open only to those legal residents of the United States or the District of Columbia, who are 21 years of age or older as of the date of their entry. Employees of Shoreline Sightseeing, partners affiliated with the giveaway, and their affiliate companies, suppliers as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. The Promotion is subject to all applicable federal, state and local laws and regulations and is void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s Administrator’s decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein. The promotion consists of a Giveaway.
2. Sponsor: The Sponsor is Shoreline Sightseeing 474 N. Lake Shore Drive, Chicago IL 60611. This Giveaway is in no way sponsored, endorsed, or administered by or associated with Meta Inc., Instagram or Facebook.
3. Giveaway Entry Period: Friday, March 7, 2025 at 12PM CST promotion period begins. (“The Promotion Period”). Promotion Period ends March 11, 2025 at 11:59PM CST.
4.Timing: All random selections will be made within 24 hours of the “Promotional Period” expiration. Subject to listed details on the Instagram Post.
5. How To Enter: Follow @ShorelineSightseeing and @ButchMcGuires on Instagram. Like the Instagram Giveaway post and tag a friend you’d bring with you. Upon completed requirements you automatically will receive one (1) entry into the Giveaway. During the Promotion period, Sponsor reserves the right to list single or multiple prizes across one or many Sponsor owned social media account(s) simultaneously. All potential winners are subject to verification before any prize will be awarded. If you do not already have an Instagram account, you may sign up for one free at www.instagram.com.

Each entrant is limited to enter one (1) time during the Promotion Period. Any attempt by any entrant to obtain more than the stated number of entries by using multiple identities / logins or any other methods will void that entrant’s plays / entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registration, the authorized account holder of the profile used to register will be deemed to be the entrant or player. Potential winners may be required to show proof of being the authorized account holder.

6. Verification of Potential Winners: Receiving a prize is contingent upon compliance with these Official Rules. Sponsor will conduct a random drawing on March 12, 2025 from the timely made entries. Winners will be selected at random. The potential Giveaway winner will be notified by email or direct message (social media) within 24 hours of random selection. If a potential winner of any prize has not responded within 24 hours of the email or direct message being sent to them, they forfeit the prize and an alternate potential winner will be randomly selected. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. Drawings will continue until such time as the prize is awarded to an eligible, responsive winner as determined by Sponsor. Sponsor is not responsible for any delay or cancellation of the Prize delivery due to unforeseen circumstances, or those outside of Sponsor’s control.
ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR OR ADMINISTRATOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE GIVEAWAY. Prizes: The St. Patrick’s Day Giveaway Prize consists of: Four Architecture River Cruise tickets to ride on the green river between March 15th 2025 through March 17th 2025, One $100 Gift Card to Butch McGuire’s, Four Butch McGuire’s mugs and Four Shoreline Sightseeing St. Patrick’s Day hats. Total Value of the prize is priced at $488. All costs, fees, and expenses associated with a prize or the acceptance and use of any element of a prize are the sole responsibility of the winner. Odds of winning depend on the number of eligible entries received.
8. Release: By participating in the Giveaway, Entrants confirm that they have read and agree to be bound by the terms of these Official Rules and the Privacy Policy, authorize Sponsor to contact them via email in connection with this Giveaway, and agree to the decisions of the Sponsor which shall be final and binding in all respects. Participation in the Giveaway constitutes permission for the Sponsor and its designees to use the Entrant’s name, likeness, voice, biographical information, prize information, quotes attributable to Entrant, and any other elements of Entrant’s persona for purposes of advertising and trade in any and all media now known or otherwise developed without further compensation or review.
Sponsor and the other Giveaway Entities assume no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty, failed, garbled or jumbled electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Giveaway; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers, software or providers utilized in any aspect of the operation of the Giveaway; (d) inaccessibility or unavailability of the Internet, any other platforms, or any combination thereof; (e) any injury or damage to Entrant’s or to any other person’s computer which may be related to or resulting from any attempt to participate in the Giveaway; or (f) any other claims related to participation in the Giveaway, including without limitation any claims of intellectual property infringement, violation of any rights of privacy or publicity or any personal injury or property damage. Sponsor and the other Giveaway Entities are not responsible for the failure of any order to be received for any reason or for any delay in the processing or failure to process any order or entries. Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the order process or the operation of the Giveaway; violates the Official Rules; is suspected of cheating, fraud, or acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any Entrant who uses or is suspected of using cheating, fraudulent means, unauthorized ordering methods, or otherwise attempts to participate multiple times, or with multiple identities, and/or addresses will be disqualified. Any attempt by any person to undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. If, for any reason, the Giveaway is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Giveaway, then Sponsor reserves the right in its sole discretion to cancel, modify, suspend or terminate the Giveaway in whole or in part. In the event Sponsor experiences a technical failure during admission of the Giveaway that causes the Giveaway to be suspended, Sponsor shall select a winner(s) by random drawing(s) from all valid entries received up to the point of the technical failure.
Without limiting any other provision in these Official Rules, the Sponsor and Giveaway Entities are not responsible or liable to any Entrant or winner (or any person claiming through such Entrant or winner) for failure to supply the prize or any part thereof in the event that any of the Sponsor or Giveaway activities or operations or activities are affected by any cause or event beyond the sole and reasonable control of the applicable Sponsor or Giveaway Entity (as determined by Sponsor in its sole discretion), including, without limitation, by reason of any acts of God, equipment failure, threatened or actual terrorist acts, air raid, act of public enemy, war (declared or undeclared), civil disturbance, insurrection, riot, epidemic, pandemic, fire, explosion, earthquake, flood, hurricane, unusually severe weather, blackout, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow- down, any law, rule, regulation, action, order, or request adopted, taken, or made by any governmental or quasi-governmental entity (whether or not such governmental act proves to be invalid), or any other cause, whether or not specifically mentioned above.
TO THE FULLEST EXTENT PERMITTED BY LAW, AS A CONDITION OF ENTRY INTO THE GIVEAWAY, ALL ENTRANTS AGREE TO FULLY AND IRREVOCABLY RELEASE, INDEMNIFY AND HOLD HARMLESS SPONSOR AND THE OTHER GIVEAWAY ENTITIES, FROM AND AGAINST ANY AND ALL LIABILITY, CLAIMS OR ACTIONS OF ANY KIND WHATSOEVER FOR INJURIES, DAMAGES, OR LOSSES TO PERSONS OR PROPERTY WHICH MAY BE SUSTAINED IN CONNECTION WITH: PARTICIPATING IN ANY ASPECT OF THE GIVEAWAY; THE RECEIPT, OWNERSHIP OR USE OF ANY PRIZE AWARDED; PREPARING FOR, PARTICIPATING IN OR TRAVELING TO AND/OR FROM ANY PRIZE- RELATED OR GIVEAWAY-RELATED ACTIVITY, OR; ANY TYPOGRAPHICAL OR OTHER ERROR IN THESE OFFICIAL RULES OR ANY “CALL TO ACTION” POSTS OR OTHER ANNOUNCEMENTS RELATING TO THE GIVEAWAY. THE WINNERS SHALL BEAR ALL RISK OF LOSS OR DAMAGE TO THEIR PRIZE AFTER SUCH PRIZE HAS BEEN DELIVERED. SPONSOR AND THE OTHER GIVEAWAY ENTITIES MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND CONCERNING THE APPEARANCE, SAFETY OR PERFORMANCE OF ANY PRIZE(S).
EACH ENTRANT UNDERSTANDS AND AGREES THAT ALL RIGHTS UNDER SECTION 1542 OF THE CIVIL CODE OF CALIFORNIA AND ANY SIMILAR LAW OF ANY STATE OR TERRITORY OF THE UNITED STATES ARE HEREBY EXPRESSLY WAIVED BY HIM/HER AGAINST THE SPONSOR AND GIVEAWAY ENTITIES. SECTION 1542 READS AS FOLLOWS:
“CERTAIN CLAIMS NOT AFFECTED BY A GENERAL RELEASE. A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, AND THAT IF KNOWN BY HIM OR HER WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”
By receipt of any prize, winner agrees to release and hold harmless Sponsor, partner affiliated with the Giveaway, and any respective affiliates, suppliers, distributors, advertising/promotion agencies and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action including but not limited to, personal injury, death or damage to or loss of property, arising out of participation in the Promotion or receipt or use or misuse of any prize.
9. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt or use or misuse of any prize. If for any reason an entrant’s entry or play is confirmed to have been erroneously deleted, lost or otherwise destroyed or corrupted, entrant’s sole remedy is another Giveaway entry, if possible. If the Promotion, or any part of it, is discontinued for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
10. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the Circuit Court of Cook County or the United States District Court located in Chicago, IL; (2) any and all claims, judgements and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental or consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Illinois, without giving effect to any choice of law or conflict of law rules (whether of the State of Illinois or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Illinois.
11. One-Year Time Limit to Raise Disputes or Claims. You agree that any dispute, claim or lawsuit, regardless of form, that may arise out of or related to the Giveaway, must be filed within ONE (1) YEAR of the action, omission, event or occurrence giving rise to the dispute, claim(s) or lawsuit. After the expiration of the one-year period, such dispute, claim(s) or lawsuit will be time-barred and prohibited, without regard to any longer period of time which may be provided by any period of limitation or pursuant to law or statute
12. Waiver of Jury Trial and Class Action Waiver. BOTH ENTRANT AND SPONSOR HEREBY WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO HAVE A TRIAL IN FRONT OF A JURY, except as provided herein. To fullest extent permitted by applicable law, you and we agree to bring any claim or dispute, whether in arbitration, or court as permitted by these terms, ON AN INDIVIDUAL BASIS ONLY, AND NOT AS A CLASS ACTION OR COLLECTIVE ACTION. There shall be no right or authority for any claim or dispute to be brought, heard or arbitrated as a class or collective action (“Class Action Waiver”).
13. Publicity: Except where prohibited, participation in the Giveaway constitutes winner’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, without further payment or consideration.
14. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Giveaway, as determined by Sponsor in its sole discretion. In such an event, Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The prize is subject to the rules and regulations of each of the companies that are supplying tickets.
15. Taxes: All costs, taxes, fees, and expenses associated with a prize or the acceptance and use of any element of a prize not specifically addressed above are the sole responsibility of the winner. All federal, state, and local taxes on prize are winner’s responsibility. In the US, prize winners are required to submit to the Sponsor a completed W9, then will be issued a 1099 tax form for the actual retail value of the prize when value is greater than $600.

17. Severability: If any term of provision of these Official Rules is found under the law to be invalid or unenforceable, then such specific term or provision shall be of no force and effect and shall be severed, and the remainder of these Official Rules shall continue in full force and effect
